Dave Grant, a 1972 cum laude and law review editor-in-chief from Loyola Law
School Los Angeles, and a senior founding partner of Grant, Genovese & Baratta,

Los Angeles Superior Court: over 25 jury verdicts and court judgments involving a wide array of disputes, including, for example, the successful recovery in a court trial by an Orange County developer against the state’s then largest commercial real property brokerage company for a decree of specific performance at a value of $82 million, plus the recovery of costs and fees; the successful defense of a preeminent investment banking firm and its principals against claims of breach of fiduciary duty seeking over $40 million; and the successful jury trial defense of fraud and breach of fiduciary claims against the state’s then second largest commercial real estate brokerage company.
United States District Court, Central District: a successful inverse condemnation verdict and several court awards, including sustaining the right of the founder (and his heirs) of a well-known local and national restaurant chain to continue collecting an income stream of royalties in excess of $100 million. Judge Matt Byrne, Jr. ruled for the Plaintiff.
Orange County Superior Court: over thirty-five jury verdicts and court judgments involving a wide array of business and real estate disputes, including for example: the successful defense of the Teachers Retirement System of the State of Illinois against claims it breached a $35 million loan commitment, concerning the purchase of the Buena Park Shopping Mall. The trial judge was the Hon. Ray Ikola and his decision was affirmed on appeal; obtaining in a seven day jury trial a defense verdict on behalf of an Orange County developer sued by a large statewide brokerage firm for $2.5 million; the successful recovery of over $12 million plus $2.0 million in punitive damages on behalf of 89 elderly investors in a 55 day jury trial against a statewide fraudulent Ponzi scheme penetrated by Dan Harkey and his Point Center and National Financial Lending entities: and the defense of a public company, its subsidiary and directors who were sued by a qui tam plaintiff under the Insurance Code for allegedly making false and fraudulent insurance claims, with the exposure of over $100 million if found liable. After a three week bench trial before Judge Craig Griffin, the court found in favor of all defendants and dismissed the claims.
San Diego Superior Court: 2 eminent domain verdicts and a phase one court judgment in defense of claims of fraud and breach of fiduciary duties against a venerable San Diego developer.
San Bernardino, Riverside, Ventura, Santa Barbara and Bakersfield Superior Courts: 6 verdicts and 5 court judgments involving: Breach of Contract, Declaratory Relief, Fraud, Defamation, Interference, Partition and Declaratory Relief.
Texas District Court (Lubbock and Texarkana): Two matters successfully defending a prominent Orange County developer: a successful verdict in a five day jury trial in Lubbock on behalf of the developer who owned a hemp plantation in Haiti and declined to pay for $650,000 for faulty seeds, and a successful court judgment on behalf of the same developer in Texarkana against claims of financial fraud.
Recovery of Over $12.0 Million in damages (including punitive) — via jury verdict — 55 days of trial — on behalf of a group of 89 elderly investors in a Ponzi/fraud case against a hard money lender and its principal.
A complete successful defense via the trial court’s Statement of Decision in a 40-day trial of a complex trade secret, fraud and insurance fraud brought by a bounty-hunter — the risk exposure was well over $100,000,000. Successful defense of 300+ homeowner’s multi-million dollar claim against developer in a mixed-use Newport Beach development (2 phases: court and jury).
