In a complex and challenging case, our firm successfully represented a homeowners association in the matter of Chakalis v. Elevator Solutions, Inc. (BC 340958).
The case involved a thirty-six-year-old woman who suffered severe injuries when an elevator she occupied fell six stories after the hydraulic line burst. The plaintiff claimed orthopedic and neurological injuries, post-traumatic stress disorder, and toxic poisoning from contaminated hydraulic fluid, which she alleged led to a liver transplant and over $2 million in medical bills.
The plaintiff had rejected a $4 million settlement offer before trial, instead asking the jury for a $10 million verdict. During the three-week trial, the GGB legal team, led by James M. Baratta, successfully demonstrated that the plaintiff’s treating physician, who was not a party to the suit, had committed malpractice and caused her condition.
Ultimately, the jury agreed with our defense, returning a net verdict against our client for only $119,053. This significant outcome underscored our ability to effectively manage and defend complex litigation, achieving a favorable result for our client.
