Defect Defense Win in Woodchipper Wrongful Death Case

Wrongful Death Case Victory

Defending the seller in a tragic wrongful death suit involving a defective product claim.

In a tragic and challenging case, GGB successfully defended the seller in a wrongful death suit in Jimenez v. Morbark (BC 416040). The case involved a tree trimmer who was tragically pulled into a wood chipper, resulting in his death. The lawsuit was brought by his widow and four children, who claimed the product was defective.

Our Insurance Defense team, led by James M. Baratta, orchestrated the case, conducting thorough investigations and gathering evidence. Throughout the proceedings, we demonstrated that while the product was found to be defective, there was insufficient proof of causation between the defect and the tragic accident.

The court’s decision to rule in favor of our client, despite the defect, highlighted our ability to effectively manage and defend complex product liability and wrongful death litigation.
